2023년 7월 19일에 발효된 새로운 유럽 기계 기술 지침(Machinery Directive, EU 2023/1230)이 2027년 1월 20일부터 강제 적용됩니다. 2027년 적용 시점에 맞춰 위험성 평가(Risk Assessment) 항목에 사이버 보안과 소프트웨어 업데이트 관리 방안을 미리 반영하는 등 선제적 조치가 필요합니다.

새로운 유럽 기계 기술 지침(Machinery Directive, EU 2023/1230) 주요 변경 사항

디지털 현대 기술 반영 및 법적 구속력 강화	가장 큰 차이점은 디지털화된 현대 기술(AI, 사이버 보안 등)을 반영하고, 법적 구속력을 강화했다는 점입니다. ​ "(12) … Thus, this Regulation should cover the safety risks stemming from new digital technologies."
고위험 기계 6종 강제 인증	기존의 Annex IV(고위험 기계 목록)가 Annex I으로 변경되면서 관리가 엄격해졌습니다. 과거에는 고위험 기계라도 표준(Harmonized Standards)을 준수하면 자가 선언(Self-declaration)이 가능한 경우가 있었으나, 이제 AI를 포함한 특정 고위험 기계 6종은 반드시 공인기관(Notified Body)의 형식 승인을 받아야 합니다. ​ "Annex I, Part A, Categories of machinery or related products to which a procedure referred to in Article 25(2) shall be applied; 6. Machinery that has embedded systems with fully or partially self-evolving behaviour using machine learning approaches ensuring safety functions that have not been placed independently on the market, in respect only of those systems."
'실질적 변형' 발생 시 CE 인증 재수행	새 규정은 기계의 성능이나 용도를 크게 바꾸는 “실질적 변형(Substantial Modification)”이 발생할 경우, 개조한 사람을 '제조자'로 간주하여 CE 인증을 다시 수행하도록 명확히 규정했습니다. ​ "Article 18, A natural or legal person that carries out a substantial modification of machinery or a related product shall be considered to be a manufacturer for the purposes of this Regulation and shall be subject to the obligations of the manufacturer set out in Article 10 for that machinery"
안전 기능 수행 소프트웨어를 독립적 안전 부품으로 관리	과거에는 기계적 스위치나 센서 위주였다면, 이제는 안전 기능을 수행하는 소프트웨어가 독립적인 '안전 부품'으로 관리됩니다. 무선 네트워크(Wi-Fi, Bluetooth)로 기계를 제어한다면 사이버 보안(Cybersecurity) 설계 기록을 기술 문서에 포함해야 합니다. ​ "(25) Other risks related to new digital technologies are those provoked by malicious third parties that have an impact on the safety of products within the scope of this Regulation. In this respect, manufacturers should be required to adopt proportionate measures which are limited to the protection of the safety of the product within the scope of this Regulation. This does not preclude the application to products within the scope of this Regulation of other Union legal acts specifically addressing cybersecurity aspects. ANNEX II, INDICATIVE LIST OF SAFETY COMPONENTS, 18. Software ensuring safety functions."
디지털 매뉴얼 제공 허용	디지털 매뉴얼: 종이 책자 대신 QR 코드나 온라인 링크를 통한 디지털 설명서 제공이 허용됩니다. 단, 구매자가 요청할 경우 종이 매뉴얼을 무료로 제공해야 하며, 일반 소비자용 기계는 필수 안전 정보를 종이로 제공해야 합니다. ​ "Instructions and other relevant documentation may be provided in a digital printable format. However, the manufacturer should ensure that distributors can provide, at the request of the user at the time of the purchase, the instructions for use in a paper format free of charge. The manufacturer should also consider providing the contact details where the user can request the instructions to be dispatched by mail."
